Leg Up Equine is operated by Pure Oil New Zealand Limited.

1. About these terms

These Terms and Conditions apply to your access to and use of the Leg Up Equine website at legup.nz, including purchases made through our online store.

The website and Leg Up Equine business are operated by Pure Oil New Zealand Limited.

In these terms, “Leg Up”, “we”, “us” and “our” refer to Pure Oil New Zealand Limited, trading as Leg Up Equine.

By using our website or placing an order, you agree to these Terms and Conditions together with our:

  • Refund and Returns Policy;
  • Shipping Policy; and
  • Privacy Policy.

If you do not agree to these terms, you should not use the website or place an order.

2. New Zealand law and consumer rights

These terms are governed by New Zealand law.

Nothing in these terms limits or excludes any rights or remedies that cannot lawfully be limited or excluded, including rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

If you acquire products for personal, domestic or household use, you may have rights under the Consumer Guarantees Act.

3. Eligibility to order

You must be at least 18 years old and legally capable of entering into a contract to place an order through our website.

You must provide accurate, current and complete information when placing an order.

Customers are not required to create a traditional Leg Up website account. However, Shopify may retain customer, checkout and order details as part of operating the online store.

4. New Zealand sales only

Our online store is intended for customers with eligible New Zealand delivery addresses.

We do not accept orders for overseas delivery.

We do not deliver to PO Boxes.

Delivery to the Chatham Islands and some other offshore New Zealand islands is not included within our standard delivery service and must be confirmed with us before an order is placed.

5. Products and animal-care information

Leg Up products must be used in accordance with the product label, feeding directions and other information supplied with the product.

Information on our website is general information only. It is not veterinary, medical or individual animal-nutrition advice and should not be treated as a substitute for professional advice.

Every animal is different. Product suitability may depend on factors including:

  • the animal’s age;
  • weight;
  • condition;
  • health;
  • workload;
  • existing diet;
  • other supplements; and
  • medications or treatments.

You are responsible for:

  • checking that a product is suitable for the intended animal;
  • reading and following the product label and feeding directions;
  • introducing dietary changes appropriately;
  • storing and handling products correctly; and
  • seeking advice from a veterinarian or suitably qualified animal-nutrition professional where appropriate.

Seek professional advice before using a product for an animal with a known health condition, special dietary requirement, suspected allergy or pregnancy, or where the animal is receiving medication or other supplements.

Contact a veterinarian promptly if an animal experiences an unexpected or adverse reaction.

Nothing in this section removes any guarantee or obligation that applies under New Zealand consumer law.

6. Product descriptions

We take reasonable care to ensure product descriptions, photographs, ingredients, pack sizes, feeding information and other website content are accurate.

Packaging, labels, colour or appearance may change from time to time. Images may be illustrative, and colours may display differently between devices.

Where website information conflicts with mandatory information printed on the current product label, follow the product label or contact us before using the product.

We may update product information when formulations, packaging or legal requirements change.

7. Availability

Products are subject to availability.

Adding a product to your shopping cart does not reserve that product.

If an ordered product is unavailable, we may:

  • contact you to discuss an alternative;
  • place the product on backorder with your agreement;
  • remove the unavailable product and refund it; or
  • cancel and refund the affected order.

We will not substitute a materially different product without your agreement.

8. Prices and GST

Unless stated otherwise, prices displayed on the Leg Up website:

  • are in New Zealand dollars; and
  • include Goods and Services Tax.

Prices, specials and product availability may change without notice.

The price that applies to an order is the price displayed at checkout when the order is submitted, subject to the section below concerning genuine errors.

Delivery charges, where applicable, will be displayed before you complete the order.

Free standard delivery applies to online orders of $90 or more, including GST, in accordance with our Shipping Policy.

9. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions, including:

  • start and end dates;
  • minimum-spend requirements;
  • product exclusions; and
  • limits on use.

Unless expressly stated otherwise:

  • only one promotional code may be used per order;
  • codes cannot be exchanged for cash;
  • codes cannot be applied retrospectively;
  • discounts apply only during the stated promotional period; and
  • the value of returned products will be based on the amount actually paid.

We may decline or cancel the use of a code where it has expired, is not valid for the order, has been misused or was issued in error.

10. Orders and formation of a contract

Submitting an order is an offer to purchase the selected products under these terms.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean we have accepted it.

A contract for the sale of the products is formed when we accept the order by dispatching it or otherwise expressly confirming acceptance.

We may refuse or cancel an order before dispatch where:

  • a product is unavailable;
  • payment is not authorised;
  • delivery information is incomplete or invalid;
  • we reasonably suspect fraud or unauthorised activity;
  • an order exceeds a stated quantity limit;
  • the order appears to be for unauthorised resale;
  • an obvious pricing or product-information error has occurred; or
  • accepting the order would breach the law.

If we cancel an order after receiving payment, we will refund the applicable amount.

11. Payment

Payment must be made using one of the payment options offered at checkout.

Payments are currently processed through Shopify Payments and its payment partners.

You confirm that you are authorised to use the selected payment method.

We do not ordinarily receive or retain your complete payment-card number.

12. Pricing and website errors

We may correct genuine errors in:

  • product descriptions;
  • prices;
  • promotions;
  • shipping charges; or
  • availability.

If an obvious error affects an order, we will contact you and give you the option of:

  • proceeding with the corrected information or price; or
  • cancelling the affected order for a full refund.

We will not rely on this section to engage in misleading pricing or other conduct prohibited by the Fair Trading Act.

13. Delivery

Our Shipping Policy forms part of these terms.

We aim to deliver urban orders within 2–5 business days in total.

Rural deliveries may take up to two additional business days and will generally be delivered within approximately 4–7 business days.

Delivery dates and tracking information are estimates and may be affected by matters outside our reasonable control.

Risk in a product passes to you when the product is delivered to the address you supplied or collected on your behalf, subject to your rights under New Zealand consumer law.

Ownership of the products passes when we have received full payment.

14. Returns, refunds and faulty products

Our Refund and Returns Policy explains how to report damaged, faulty, missing or incorrectly supplied products and how we consider change-of-mind requests.

That policy does not limit your rights under the Consumer Guarantees Act or other applicable law.

15. Storage and use

You must store products in accordance with their labels and any instructions supplied with them.

You should not use a product that:

  • has passed its stated expiry or best-before date where its suitability is in doubt;
  • has damaged or compromised packaging;
  • appears contaminated or materially different from its normal condition; or
  • has not been stored as directed.

Contact us if you have concerns about the condition, safety or authenticity of a product.

16. Website use

You may use the website only for lawful purposes.

You must not:

  • interfere with the security or operation of the website;
  • introduce malicious software or harmful code;
  • gain or attempt to gain unauthorised access to the website or related systems;
  • scrape, harvest or systematically extract website information without permission;
  • use the website to infringe another person’s rights;
  • submit false, misleading, abusive or unlawful material;
  • impersonate another person;
  • carry out fraudulent transactions; or
  • use the website in a way that breaches applicable law.

We may restrict or suspend access where we reasonably believe the website is being misused.

17. Intellectual property

Unless stated otherwise, the website and its content, including text, photographs, graphics, logos, product names, videos and design elements, are owned by or licensed to Pure Oil New Zealand Limited and are protected by intellectual-property law.

You may view and make reasonable personal use of the website.

You must not reproduce, republish, distribute, modify, commercially exploit or create derivative works from website content without our prior written permission, except where permitted by law.

18. Reviews, comments and submitted content

If you submit a review, testimonial, photograph, competition entry, comment or other content, you confirm that:

  • it is accurate and based on your genuine experience;
  • you own it or have permission to submit it;
  • it does not infringe another person’s rights;
  • it is not unlawful, defamatory, misleading, abusive or obscene; and
  • it does not contain malicious code or private information about another person without permission.

You retain ownership of your content.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit and publish that content for operating and promoting Leg Up and its products.

We may moderate, decline or remove submitted content where we reasonably consider it inappropriate, misleading, unlawful or irrelevant.

We will not materially alter the meaning of a customer review when making minor edits for spelling, length or formatting.

19. Third-party services and links

Our website may use or link to third-party services, including:

  • Shopify;
  • Shopify Payments;
  • Google;
  • YouTube;
  • Microsoft;
  • Meta;
  • Klaviyo;
  • Yotpo;
  • courier providers; and
  • other technology or service providers.

We are not responsible for the content or practices of an independent third-party website.

Accessing a third-party service may be subject to that provider’s own terms and privacy policy.

This section does not limit our responsibility for third parties acting on our behalf where responsibility cannot lawfully be excluded.

20. Website availability

We aim to keep the website accurate, secure and available, but we do not guarantee that it will always be uninterrupted or error-free.

We may suspend, withdraw, update or restrict parts of the website for maintenance, security, operational or legal reasons.

We will take reasonable steps to address website issues that materially affect an accepted order.

21. Liability

To the maximum extent permitted by law, we are not liable for loss arising solely from:

  • misuse of a product;
  • failure to follow product labels, feeding directions or storage instructions;
  • use of a product for an animal for which it is not reasonably suitable;
  • combining products, supplements or medications without appropriate advice;
  • unauthorised alteration or repackaging of a product;
  • inaccurate information supplied by the customer; or
  • events outside our reasonable control.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed.

Nothing in these terms excludes or limits liability:

  • under the Consumer Guarantees Act where it applies;
  • under the Fair Trading Act where liability cannot be excluded;
  • for fraud or fraudulent misrepresentation;
  • for wilful misconduct;
  • for death or personal injury caused by negligence where liability cannot lawfully be excluded; or
  • where exclusion or limitation is otherwise prohibited by law.

22. Business customers

If you acquire products in trade for business purposes, and both parties are in trade, the parties may agree in writing that provisions of the Consumer Guarantees Act, Fair Trading Act or Contract and Commercial Law Act do not apply to the extent permitted by those Acts.

Any contracting-out arrangement must satisfy the applicable legal requirements, including that it is fair and reasonable.

Separate trade, wholesale or bulk-purchase terms may apply to purchases made outside the Leg Up website.

23. Privacy

Our collection, use, disclosure and storage of personal information are governed by our Privacy Policy.

24. Electronic communications

You agree that we may send order confirmations, invoices, delivery updates and other transactional information electronically using the contact details you provide.

Marketing communications will be sent in accordance with the Unsolicited Electronic Messages Act 2007 and our Privacy Policy.

25. Events outside our control

We are not responsible for delay or failure caused by an event outside our reasonable control, such as:

  • severe weather;
  • natural disaster;
  • fire;
  • transport disruption;
  • industrial action;
  • supply-chain interruption;
  • failure of essential services;
  • government action; or
  • widespread technology outage.

We will take reasonable steps to minimise the effect of the event and fulfil or refund affected orders as appropriate.

This section does not remove rights or remedies available under New Zealand consumer law.

26. Severability

If any part of these terms is found to be invalid or unenforceable, that part will be modified or removed only to the extent necessary.

The remaining terms will continue to apply.

27. No waiver

If we do not immediately enforce a right under these terms, that does not mean we have waived that right.

28. Changes to these terms

We may update these terms to reflect changes to our business, website, services or legal obligations.

The updated terms will be published on our website with a revised “last updated” date.

Changes will apply from the date they are published and will not retrospectively alter an order already accepted, unless required by law or agreed with you.

29. Governing law

These terms and any dispute concerning the website or an order are governed by New Zealand law.

The New Zealand courts have non-exclusive jurisdiction, subject to any rights you have to use the Disputes Tribunal or another applicable dispute-resolution process.
